Since the implementation of\u00a0President Trump’s Executive Proclamation<\/a>\u00a0on\u00a0June 24th, 2020,\u00a0<\/strong>the\u00a0H1B, H2B, J, and L visas <\/strong>have all been\u00a0postponed for 180 days until December 31st, 2020<\/strong>.\u00a0The new Presidential Proclamation should\u00a0only impact new labor applications as in those who have\u00a0not yet obtained a visa to travel to the USA.\u00a0Any foreigner who currently holds a valid unexpired visa (including in one of these categories) is exempted from this proclamation.<\/strong><\/div>\n

Yet the\u00a0O1\u00a0<\/strong>Visa<\/strong> has not been targeted by this executive order, and is still a viable option for staying in the USA. The\u00a0O1 visa<\/strong> is the only option for those\u00a0either already in the US on another visa willing to find a way to stay, or internationals looking to make the move to the States. Thus, we have compiled some information regarding the O1 visa<\/strong>, and we hope it assists you in understanding if the O1 Visa is right for your current situation or for one of your employees.<\/div>\n

What is the O1 Visa?<\/h4>\n

The United States Citizenship and Immigration Services (USCIS)<\/strong> defines the O1 nonimmigrant visa<\/strong> as follows, “…(it) is for the individual\u00a0who possesses extraordinary ability<\/strong> in the sciences, arts, education, business, or athletics, or who has a demonstrated record of extraordinary achievement in the motion picture or television industry and has been recognized nationally or internationally for those achievements.”<\/p>\n

Extraordinary ability is defined as someone with distinction within their field. Distinction means a high level of achievement in the field of the arts evidenced by a degree of skill and recognition substantially above that ordinarily encountered to the extent that a person described as prominent is renowned, leading, or well-known in the field of arts. Considering the\u00a0O1 Visa<\/strong> is administered through the USCIS<\/strong>, it will require a lawyer for this process. In comparison to the J1 Visa that\u00a0is administered through the State Department<\/strong>, and does not require any legal representation. 10 Steps\u00a0to preparing your O1 Visa application<\/strong><\/h4>\n

1. RESUME<\/strong>:\u00a0Have a\u00a0detailed resume ready.<\/p>\n

2. TIMELINE<\/strong>: Discuss timeline of each of the preparation steps to follow. Generally \u2013 Document gathering and case plan creation by client in consult with attorney 2-4 weeks.<\/p>\n

\n3. SPONSORSHIP<\/strong>: Decide on sponsorship type (employer or agent).<\/p>\n<\/div>\n

4. RECOMMENDATION LETTERS<\/strong>:\u00a0Collect a list of at least seven references who can provide recommendation letters commenting on your professional experience and achievements.<\/p>\n

5. SUPPORTING DOCUMENTS<\/strong>: Prepare supporting documentation (media articles related to professional projects, copies\u00a0of awards\/publications, 3-year itinerary, employment letter(s), portfolio, signed recommendation letters, etc.).<\/p>\n

6. ADVISORY OPINION<\/strong>: Obtain advisory opinion from the appropriate consulting entity. Fill out the form below<\/strong> at the end of the post if you want us to help you!<\/p>\n

7. FORMS & FEES<\/strong>: Obtain signed immigration forms and filing fees.<\/p>\n

8. SUBMISSION<\/strong>: Submit O-1 package (USCIS processing times vary between 1-3 months. For an additional \u201cPremium Processing\u201d fee, USCIS will process the case within 15 calendar days).<\/p>\n

9. RFE RESPONSE<\/strong>: Respond to any Request for Further Evidence (\u201cRFE\u201d).<\/p>\n

10. CHANGE OF STATUS\/VISA<\/strong>: Once approved, change of status (if in the US already, status change occurs upon approval) or consular processing to obtain O1 Visa<\/strong> (in your home country).<\/p>\n<\/div>\n
